Welcome to Mesa! These Terms of Service ("Terms") govern your use of the Mesa mobile application ("App") and related services provided by Mesa ("we," "our," or "us"). By downloading, accessing, or using Mesa, you agree to be bound by these Terms.
1. Eligibility
To use Mesa, you must:
- Be at least 18 years old
- Have the legal capacity to enter into a binding agreement
- Not be prohibited from using our services under applicable laws
- Provide accurate and truthful information when creating your account
By using Mesa, you represent and warrant that you meet all eligibility requirements.
2. Account Registration
2.1 Account Creation
To access certain features, you must create an account by providing:
- Your real name
- Valid email address
- Accurate age and location
- A profile photo that clearly shows your face
2.2 Account Security
You are responsible for:
- Maintaining the confidentiality of your login credentials
- All activities that occur under your account
- Notifying us immediately of any unauthorized access
2.3 Account Termination
You may delete your account at any time through the App settings. We may suspend or terminate your account if you violate these Terms.
3. Using Mesa
3.1 Service Description
Mesa is a social platform that connects people for social events and table sharing at venues. Users can:
- Hosts: Create tables and invite guests to join events
- Guests: Discover and request to join tables
- Venue Owners: Verify their venues and manage events
3.2 User Conduct
When using Mesa, you agree NOT to:
- Provide false or misleading information
- Impersonate another person or entity
- Harass, abuse, or threaten other users
- Post offensive, discriminatory, or illegal content
- Use the App for any illegal purpose
- Spam or send unsolicited messages
- Attempt to circumvent any security features
- Scrape, collect, or harvest user data
- Use bots or automated systems to access the App
- Engage in fraud or deceptive practices
4. Tables and Events
4.1 Creating Tables
When creating a table, hosts must:
- Provide accurate event details (venue, date, time, price)
- Honor commitments made to accepted guests
- Not discriminate based on protected characteristics
- Comply with venue rules and local laws
4.2 Joining Tables
When joining a table, guests agree to:
- Provide accurate information in their request
- Honor their commitment if accepted
- Treat hosts and other guests with respect
- Comply with any stated table rules
4.3 Mesa's Role
Mesa is a platform that facilitates connections. We are NOT:
- A party to any agreement between hosts and guests
- Responsible for user conduct at events
- Liable for the quality or safety of events
- An event organizer or venue operator
5. Payments
5.1 Payment Processing
Payments are processed through Stripe, a third-party payment processor. By making payments, you agree to Stripe's terms of service.
5.2 Pricing
All prices are displayed in Colombian Pesos (COP) unless otherwise stated. Prices include applicable fees but may not include taxes required by law.
5.3 Subscriptions
Subscription services (Mesa Gold, Badges) are billed according to the selected plan:
- Subscriptions auto-renew unless cancelled
- Cancel at least 24 hours before renewal to avoid charges
- No refunds for partial billing periods
5.4 Refunds
Refund policies:
- Table Payments: Refunds are at the host's discretion for cancellations
- Subscriptions: Generally non-refundable; exceptions may apply
- Boosts: Non-refundable once activated
6. Badges and Verification
6.1 Badge System
Badges indicate user status and can be earned or purchased:
- Badge subscriptions provide visibility and feature benefits
- Earned badges are based on successful hosting history
- Badges do not guarantee any specific outcomes
6.2 Venue Verification
Venue owners may apply for verification by submitting:
- Business registration documents
- Proof of venue ownership/management
- Contact information for verification
Verification is at our discretion and may be revoked if information is found to be false.
7. Content
7.1 User Content
You retain ownership of content you post but grant us a license to use, display, and distribute it within the App. You represent that you have the right to post all content.
7.2 Prohibited Content
Do not post content that is:
- Illegal, harmful, or offensive
- Infringing on intellectual property rights
- Sexually explicit or pornographic
- Violent or promoting violence
- Discriminatory or hateful
- False or misleading
7.3 Content Removal
We may remove content that violates these Terms without notice. Repeated violations may result in account termination.
8. Intellectual Property
The Mesa name, logo, design, and all App content (excluding user content) are owned by Mesa and protected by intellectual property laws. You may not use our trademarks without permission.
9. Privacy
Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your information.
10. Disclaimers
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND.
We disclaim all warranties, express or implied, including:
- Warranties of merchantability or fitness for a particular purpose
- Warranties that the App will be uninterrupted or error-free
- Warranties regarding the accuracy of information
- Warranties regarding the conduct of other users
11. Limitation of Liability
To the maximum extent permitted by law:
- Mesa is not liable for any indirect, incidental, special, or consequential damages
- Our total liability shall not exceed the amount you paid to Mesa in the past 12 months
- We are not liable for actions or conduct of other users
- We are not liable for events that occur at venues or between users
12. Indemnification
You agree to indemnify and hold harmless Mesa, its officers, directors, employees, and agents from any claims, damages, or expenses arising from:
- Your violation of these Terms
- Your use of the App
- Your content or conduct
- Your violation of any rights of others
13. Dispute Resolution
13.1 Governing Law
These Terms are governed by the laws of Colombia.
13.2 Dispute Resolution
Any disputes shall be resolved through:
- Good faith negotiation between the parties
- Mediation if negotiation fails
- Binding arbitration in Bogotá, Colombia
14. Changes to Terms
We may modify these Terms at any time. Material changes will be communicated through the App or email. Continued use after changes constitutes acceptance.
15. General Provisions
- Entire Agreement: These Terms constitute the entire agreement between you and Mesa
- Severability: If any provision is found unenforceable, others remain in effect
- Waiver: Our failure to enforce any right does not waive that right
- Assignment: You may not assign these Terms; we may assign them freely
